Checklist: Can I Copy?

The following is a flow-chart to help you decide if you can use/copy an item for educational purposes.

Do you have permission to use this work? If yes, copy/use as directed.

If you do not have permission: is the work in the public domain? If yes, copy/use.

If the work is not in the public domain, can you use/copy it according to the tenets of fair use? If yes, copy/use.

If you cannot use the fair use exemption, if you are teaching a distance education course, you may be able to use the TEACH Act as an exemption. If yes, copy/use.

If you cannot use the TEACH Act as an exemption, does this work fit other exemptions, such as statutory exemptions, purchasing of licenses or rights...

If none of the above exemptions fit, do not copy/use this work.
